This Privacy Policy explains how Ran Akiva (an individual freelancer, hereinafter: "I", "me", "the Service Provider") collects, stores, processes, and uses personal information of users of this website ("you", "your") and the services I offer ("the Service").

This policy is written in accordance with the laws of the State of Israel, including the Protection of Privacy Law, 5741-1981 (as amended by Amendment 13, in effect from August 14, 2025), the Protection of Privacy Regulations (Information Security), 5777-2017, and the Communications Law (Telecommunications and Broadcasting), 5742-1982 ("the Spam Law").

Information you submit through this site is stored in a small personal database operated by Ran Akiva for the purpose of responding to inquiries and providing freelance services.

Following Amendment 13 to the Protection of Privacy Law, the general database registration requirement was significantly narrowed. Registration with the Database Registrar applies primarily to (a) databases whose main purpose is collecting personal information in order to transfer it to others as a business or for consideration, where the database contains information on more than 10,000 people, and (b) public bodies. A separate notification obligation to the Privacy Protection Authority applies mainly to sensitive databases containing data on more than 100,000 people. This site's database does not currently meet either threshold and is therefore not subject to registration or notification.

3.1 Information you provide voluntarily: name, email address, phone number (if provided), message content, and any other details you choose to submit through the contact form.

3.2 Information collected automatically: basic usage data (pages viewed, approximate time spent), technical information (IP address, browser type, operating system, approximate geographic location derived from IP), and access logs.

Notice regarding the contact form: providing your details is not legally required, but without them I cannot respond to your inquiry. The information you submit is sent to me directly and is used solely for the purposes described in Section 4 below.

I collect and use your personal information for the following purposes, relying on the following justifications for processing under Israeli law:

• Responding to inquiries - based on your consent and on the need to take steps at your request prior to entering into an engagement.
• Providing freelance development and QA services - based on the performance of an engagement with you.
• Service-related communication - replying to messages and sending information directly related to your inquiry, based on your consent and on legitimate interest in operating the Service.
• Site operation, security, and fraud prevention - based on legitimate interest in protecting the Service, preventing abuse, and protecting legal rights.
• Compliance with legal obligations - including tax, accounting, and any other obligation under applicable law.
• Marketing communications - only with your explicit prior consent (opt-in), in accordance with Section 30A of the Communications Law. An easy unsubscribe option will be included in every such message.

I do not sell or rent personal information. I may share information with the following categories of service providers and recipients, strictly for the purposes described above:

• Hosting and infrastructure: Base44 (which hosts the site and stores contact form submissions).
• Email: Google (Gmail) for receiving and replying to contact messages.
• Authorities: if required by binding law, court order, or to defend legal rights.
• Business transfer: in the event of a sale or transfer of the freelance activity - subject to legal requirements.

I do not currently use Google Analytics, Meta Pixel, WhatsApp Business, or other tracking/marketing tools on this site. If this changes, this policy will be updated.

International transfers: some of the service providers above process data outside of Israel (including the United States and European Union). Such transfers are made in accordance with applicable law and rely on the providers' standard contractual safeguards and security measures, including encryption in transit.

Personal information is retained only for as long as needed for the purposes described in this policy. Specifically:

• Contact form messages and related correspondence: up to 24 months from the last contact, then deleted or anonymized.
• Server access logs: up to 12 months, then deleted.
• Tax and accounting records (where applicable, e.g., invoices for paid engagements): up to 7 years, as required by Israeli tax law.

Information may be retained for longer periods only where required by law or for legitimate legal defense.

If I discover that information has been submitted by a minor under the age of 18 by mistake, the information will be deleted within 48 hours of discovery and will not be used.

Under Sections 13-14 of the Protection of Privacy Law, you have the right to review the personal information held about you, and to request correction or deletion of inaccurate, incomplete, or outdated information. Under Section 17C(a)(9) you also have the right to demand that I stop using your information for direct marketing purposes.

If you reside in the European Economic Area (EEA) or the United Kingdom, you may additionally have rights under the GDPR/UK GDPR, including the right of access, rectification, erasure, restriction of processing, data portability, objection to processing, and the right to lodge a complaint with a supervisory authority. I will honor reasonable requests to the extent applicable.

To exercise these rights, please contact me in writing at: realma734@gmail.com. I commit to responding to legitimate requests within 30 days; for complex requests I will notify you of any necessary delay.

This site uses only essential storage required for basic functionality (for example, remembering your language preference). It does not currently set advertising, marketing, or third-party analytics cookies. If this changes in the future, this policy will be updated and, where required, consent will be requested.

I implement reasonable physical, technical, and organizational security measures in accordance with the Protection of Privacy Regulations (Information Security), 5777-2017, to protect personal information. However, no system can guarantee complete immunity against unauthorized access, and I cannot warrant that the Service will be entirely risk-free.

In the event of a security incident that may materially affect your privacy, I will take reasonable steps to notify the Privacy Protection Authority, to the extent required by law, and notify affected users without unreasonable delay. The notification will include relevant information about the nature of the incident and steps taken.

The Service may contain links to external websites. I am not responsible for their privacy practices. I recommend reviewing their policies before providing information.

I may update this policy from time to time. In the event of a material change, I will provide a prominent notice on the site or by email, and request renewed consent if required. The updated policy will take effect 7 days after publication on the site, unless otherwise stated. Your continued use of the Service after an update constitutes acceptance of the updated policy.

This policy is governed exclusively by Israeli law. The exclusive jurisdiction shall be the competent courts of the Tel Aviv-Jaffa district.

מדיניות פרטיות זו נועדה להסביר כיצד רן עקיבא (פרילנסר עצמאי, להלן: "אני", "ספק השירות") אוסף, שומר, מעבד ומשתמש במידע אישי של משתמשי האתר ("אתה", "שלך") והשירותים שאני מציע ("השירות").

המדיניות מנוסחת בהתאם לחוקי מדינת ישראל, לרבות חוק הגנת הפרטיות, התשמ"א-1981 (כפי שתוקן בתיקון 13, אשר נכנס לתוקף ב-14 באוגוסט 2025), תקנות הגנת הפרטיות (אבטחת מידע), התשע"ז-2017, וחוק התקשורת (בזק ושידורים), התשמ"ב-1982 ("חוק הספאם").

בעקבות תיקון 13 לחוק הגנת הפרטיות, חובת רישום מאגרי המידע צומצמה משמעותית. חובת רישום אצל רשם מאגרי המידע חלה בעיקר על: (א) מאגר שמטרתו העיקרית היא איסוף מידע אישי לשם מסירתו לאחר כדרך עיסוק או בתמורה, והוא כולל מידע על יותר מ-10,000 אנשים, וכן (ב) מאגרים של גופים ציבוריים. בנוסף, חובת הודעה לרשות להגנת הפרטיות חלה בעיקר על מאגרים רגישים הכוללים מידע על יותר מ-100,000 אנשים. המאגר של אתר זה אינו עומד בסיפי גודל אלה, ולכן אינו כפוף כיום לחובת רישום או חובת הודעה.

3.1 מידע שאתה מוסר מרצונך: שם, כתובת דוא"ל, מספר טלפון (אם נמסר), תוכן ההודעה, וכל פרט אחר שתבחר למסור דרך טופס יצירת הקשר.

3.2 מידע הנאסף באופן אוטומטי: נתוני שימוש בסיסיים (דפים שנצפו, זמן שהייה משוער), מידע טכני (כתובת IP, סוג דפדפן, מערכת הפעלה, מיקום גיאוגרפי משוער מתוך כתובת ה-IP) ויומני גישה.

הודעה לגבי טופס יצירת הקשר: מסירת הפרטים אינה חובה על פי דין, אך בלעדיה לא אוכל לחזור אליך. המידע שתמסור נשלח אליי ישירות ומשמש אך ורק למטרות המפורטות בסעיף 4 להלן.

אני אוסף ומשתמש במידע האישי שלך למטרות הבאות, בהתאם להצדקות לעיבוד הבאות על פי הדין הישראלי:

• מענה לפניות - מבוסס על הסכמתך ועל הצורך לנקוט צעדים לבקשתך לקראת התקשרות אפשרית.
• מתן שירותי פיתוח ו-QA פרילנס - מבוסס על ביצוע ההתקשרות איתך.
• תקשורת שירות - מענה להודעות ושליחת מידע הקשור ישירות לפנייתך, מבוסס על הסכמתך ועל אינטרס לגיטימי בהפעלת השירות.
• תפעול האתר, אבטחה ומניעת הונאות - מבוסס על אינטרס לגיטימי בהגנה על השירות, מניעת שימוש לרעה והגנה על זכויות משפטיות.
• עמידה בחובות חוקיות - לרבות חובות מס, חשבונאות וכל חובה אחרת מכוח דין.
• שיווק ישיר - אך ורק לאחר קבלת הסכמתך המפורשת מראש (opt-in), בהתאם לסעיף 30א לחוק התקשורת. בכל הודעה כזו תיכלל אפשרות הסרה נגישה.

איני מוכר או משכיר מידע אישי. ייתכן ואשתף מידע עם הקטגוריות הבאות של ספקי שירות וגורמים מקבלים, אך ורק למטרות המפורטות לעיל:

• אחסון ותשתית: Base44 (פלטפורמת האחסון של האתר, שבה נשמרות פניות מטופס יצירת הקשר).
• דוא"ל: Google (Gmail), לקבלת הודעות ומענה אליהן.
• רשויות מוסמכות: אם נדרש לכך לפי דין מחייב, צו שיפוטי, או לצורך הגנה על זכויות משפטיות.
• העברת פעילות: במקרה של מכירה או העברה של פעילות הפרילנס - בכפוף להוראות הדין.

נכון למועד עדכון מדיניות זו, איני משתמש באתר בכלים כגון Google Analytics, Meta Pixel, WhatsApp Business או כלי מעקב/שיווק דומים. אם הדבר ישתנה, המדיניות תעודכן בהתאם.

העברות מידע מחוץ לישראל: חלק מספקי השירות לעיל מעבדים מידע מחוץ לישראל (לרבות בארצות הברית ובאיחוד האירופי). העברות אלה נעשות בהתאם לדין החל ובהסתמך על הסדרי האבטחה החוזיים והטכנולוגיים הסטנדרטיים של הספקים, לרבות הצפנה בהעברה.

המידע האישי יישמר רק לפרק הזמן הדרוש למטרות המתוארות במדיניות זו. באופן ספציפי:

• הודעות מטופס יצירת הקשר והתכתבויות קשורות: עד 24 חודשים מהמגע האחרון, ולאחר מכן יימחקו או יעברו אנונימיזציה.
• יומני גישה לשרת: עד 12 חודשים ולאחר מכן יימחקו.
• תיעוד מס וחשבונאות (במקרים רלוונטיים, למשל חשבוניות בעבור התקשרות בתשלום): עד 7 שנים, כנדרש בדין המס הישראלי.

ייתכן ומידע יישמר לתקופות ארוכות יותר רק אם הדבר נדרש על פי דין או לצורך הגנה משפטית לגיטימית.

אם יתגלה כי מידע נמסר בשגגה על ידי קטין מתחת לגיל 18, המידע יימחק בתוך 48 שעות מרגע הגילוי ולא ייעשה בו שימוש.

בהתאם לסעיפים 13-14 לחוק הגנת הפרטיות, עומדת לך הזכות לעיין במידע האישי המוחזק אודותיך, ולבקש לתקן או למחוק מידע שגוי, חסר או לא עדכני. בהתאם לסעיף 17ג(א)(9), עומדת לך גם הזכות לדרוש שנפסיק להשתמש במידע שלך לצורכי שיווק ישיר.

אם הינך תושב/ת האזור הכלכלי האירופי (EEA) או הממלכה המאוחדת, ייתכן ויעמדו לך זכויות נוספות מכוח ה-GDPR / UK GDPR, לרבות זכות עיון, תיקון, מחיקה, הגבלת עיבוד, ניידות נתונים, התנגדות לעיבוד, וזכות להגיש תלונה לרשות פיקוח. אכבד בקשות סבירות במידה שהן חלות.

במקרה של אירוע אבטחת מידע העלול להשפיע באופן ממשי על פרטיותך, אנקוט באמצעים סבירים להודיע לרשות להגנת הפרטיות, ככל שהדבר נדרש לפי דין, וכן אעדכן את המשתמשים שעלולים להיות מושפעים - ללא דיחוי בלתי סביר. ההודעה תכלול מידע רלוונטי על אופי האירוע והצעדים שננקטו.

השירות עשוי לכלול קישורים לאתרים חיצוניים. אינני אחראי לנוהלי הפרטיות שלהם. מומלץ לעיין במדיניות שלהם לפני מסירת מידע.

אני רשאי לעדכן מדיניות זו מעת לעת. במקרה של שינוי מהותי, תינתן הודעה בולטת באתר או באמצעות דוא"ל, ותתבקש הסכמה מחודשת ככל שהדבר נדרש. נוסח המדיניות המעודכן ייכנס לתוקף בתוך 7 ימים ממועד פרסומו באתר, אלא אם צוין אחרת. המשך השימוש בשירות לאחר עדכון מהווה הסכמה למדיניות המעודכנת.

מדיניות זו כפופה לדין הישראלי בלבד. סמכות השיפוט הבלעדית תהיה נתונה לבתי המשפט המוסמכים במחוז תל-אביב-יפו.
